Impact Bargaining Tentative Agreement

We are pleased to announce that we have reached tentative agreement on the impact bargaining with MCPS. There are still unresolved items that will be discussed at the joint table with all unions. 

The full MOU is available for viewing HERE, but highlights of the agreement include:

  • Site-based Health and Safety (H&S) Committees with expedited dispute resolution
  • Affirmation of our H&S rights with the acknowledgement of the “risk of viral infection.”
  • Commitment to observing CDC, Maryland, and Montgomery County guidelines
  • Continuation of unusual and imperative leave, including to obtain COVID vaccinations
  • Procedure for COVID and dealing with staff, students, and visitors
  • PPE guidance
  • Building and HVAC guidelines
  • Educator preference will be a factor in returning to physical buildings
  • Meetings to be conducted virtually
  • Parties share an interest in not having staff unnecessarily in the buildings
  • Educators approved for virtual education will not normally be required to come to a physical building
  • Protections for Special Educators
  • Consideration of compelling personal reasons not covered by ADA for telework
  • Ability to take either a leave of absence or resign without prejudice if forced to return to physical classroom
  • Side letter for infants and toddlers
  • Side letter for 12-Month and Non-School Based employees
